IC Compliance Case Study: How CWS Israel Saved KellyOCG $5M in Contractor Misclassification Risk
Challenge
Misclassifying independent contractors as employees could have cost KellyOCG and their global tech client an estimated $200K–$250K per worker, not including potential government fines and social payments. The vision was to safeguard full compliance and prevent unnecessary financial and legal risks.
KellyOCG is a global Managed Service Provider (MSP) in the staffing industry. The firm needed to ensure that their client's IC engagements in Israel adhered to local laws and minimized misclassification risks. The challenge was maintaining the flexibility of engaging contingent workforce to conduct independent work while staying fully compliant with Israeli employment law.
In Israel, misclassification can lead to legal exposure, retroactive benefits, and tax liabilities. The risks include retroactive reclassification by the Israeli Labour Court as an employee-employer relationship, full liability for all statutory employment benefits (pension contributions, annual leave, severance pay) from the beginning of the engagement, National Insurance arrears on all payments made to the worker, and criminal penalties in cases of deliberate misclassification.
Solution
In 2020, CWS Israel partnered with KellyOCG to embed robust, in-country compliance processes into Kelly's Managed Service Provider (MSP) and Master Vendor (MV) offerings. The approach included:
- Annual compliance checks on all independent contractors
- Two-part surveys and interviews with each contractor and their supervisor
- Custom risk assessment tool based on Israeli labor law
- Expert legal oversight and continuous process improvement
The partnership structure allowed multinational clients using KellyOCG's Managed Service Provider (MSP) or Vendor Management System (VMS) platforms to route their Israeli contractor engagements through CWS Israel's compliant payrolling and Employer of Record infrastructure. This meant:
- Contractors in Israel who should be employees were correctly onboarded and payrolled via an EoR structure
- True independent contractors were properly assessed and engaged under compliant contracts
- All statutory obligations (pension, severance reserve, national insurance) were met automatically
- Global clients benefited from a single, integrated supplier relationship for both MSP services and Israeli compliance
