Singapore's Employment Act 1968 establishes annual leave entitlements that increase with length of service. Employees receive a minimum of 7 days of paid annual leave during their first year of employment. This entitlement rises to 8 days in the second year, 9 days in the third year, 10 days in the fourth year, and continues incrementally until reaching 14 days after 8 or more years of service. The leave must be taken within the calendar year it is earned, though employers and employees may agree to carry over unused days to the following year, subject to a maximum carryover limit of 5 days.
Section 88A of the Employment Act 1968, administered by Singapore's Ministry of Manpower, governs these provisions. The statute applies to all employees in Singapore, with limited exemptions for certain categories of workers. Annual leave is distinct from other statutory holidays and must be paid at the employee's ordinary rate of pay.
Employers must maintain clear records of leave accrual and usage for each employee. Payment in lieu of untaken leave is permitted only upon termination of employment, calculated at the employee's ordinary rate. Employers should establish written leave policies that comply with the statutory minimums and communicate entitlements clearly to staff. Payroll systems must accurately track service length to ensure correct leave accrual, as underpayment or non-provision of statutory leave can result in Ministry of Manpower enforcement action and financial penalties.
