Workers compensation

Workers' compensation in France, known as "assurance accidents du travail et maladies professionnelles," is a mandatory social insurance system that protects employees against financial hardship resulting from work-related injuries, occupational diseases, and accidents occurring during employment. The system provides coverage for medical expenses, rehabilitation costs, temporary disability benefits, permanent disability compensation, and survivor benefits in cases of fatal workplace incidents.

This compulsory insurance scheme is governed by the French Social Security Code (Code de la Sécurité Sociale), specifically Books IV and V, which establish employer obligations and employee protections. The system operates through the National Insurance Fund for Occupational Accidents and Diseases (CNAMTS) and regional branches that manage claims and benefit administration.

France's workers' compensation framework underwent significant modernization through Law 2017-1340 (effective January 1, 2018), which reformed occupational disease recognition procedures and expanded the list of compensable conditions. The system continues to evolve, with periodic updates to benefit rates and disease classifications to reflect workplace hazards and medical advances.

Employers must register with the appropriate regional CNAMTS office and pay mandatory contributions calculated as a percentage of payroll, with rates varying by industry risk classification. Payroll teams must accurately report all workplace incidents within prescribed timeframes, maintain detailed injury records, and ensure employees receive proper notification of their rights. Employers cannot require employees to contribute to workers' compensation premiums; the entire cost falls on the employer. Compliance requires timely reporting of accidents and cooperation with CNAMTS investigations to determine benefit eligibility and appropriate compensation levels.
