Workers compensation

Workers' compensation in Austria is a mandatory insurance system that protects employees against financial hardship resulting from work-related injuries, occupational diseases, and accidents occurring during employment or work-related activities. The system provides coverage for medical treatment, rehabilitation, disability benefits, and survivor benefits to dependents of deceased workers.

The Austrian Workers' Compensation Act (Allgemeines Sozialversicherungsgesetz, ASVG) and the Occupational Diseases Act (Berufskrankheitenverordnung) form the legal foundation for this mandatory social insurance scheme. The system is administered by the Austrian Social Insurance Institution for Occupational Risks (Allgemeine Unfallversicherungsanstalt, AUVA), which operates as a public body under the supervision of the Federal Ministry of Labour, Family and Youth.

Employers are required by law to register all employees with AUVA and pay contributions based on payroll and industry risk classification. Contribution rates vary by sector, ranging from approximately 0.6 percent to 3.8 percent of gross wages, reflecting different occupational hazard levels. Self-employed individuals and certain professional groups may also be covered under modified schemes.

Recent amendments have expanded coverage for mental health conditions and clarified procedures for reporting workplace incidents. Employers must report all work-related accidents resulting in incapacity exceeding three days to AUVA within specified timeframes.

Payroll teams must ensure timely registration of all eligible employees, accurate contribution calculations based on correct wage classifications, and prompt incident reporting. Maintaining detailed records of workplace injuries and occupational health measures demonstrates compliance with statutory obligations and supports the insurance system's preventive objectives.
